ITEM SUMMARY: 

                     This is a Resolution authorizing the City Manager to Execute a Memorandum of Understanding and Collaborative Agreement, known as AFFH Regional Collaboration MOU, with the cities of Frisco, Plano, Denton, Dallas, Greenville, the County of Dallas, Dallas Housing Authority, Denton Housing Authority, Frisco Housing Authority, Plano Housing Authority, McKinney Housing Authority, Grandview Housing Authority, Waxahachie Housing Authority, Cleburne Housing Authority, Ferris Housing Authority, Ennis Housing Authority, and Royse City Housing Authority for Regional Fair Housing Assessments and Regional Collaboration to Affirm Further Fair Housing.

 

 

BACKGROUND INFORMATION: 

•   The Fair Housing Act (FHA) of 1968 protects all people from discrimination when they are renting, buying, or securing financing for any type of housing, regardless of the funding source. The Fair Housing Act prohibits discrimination in housing based on disability, race, color, religion, national origin, sex and familial status (residing with children under 18). The U.S. Departments of Justice and Housing and Urban Development share responsibility for enforcing the Fair Housing Act. 

                     Municipalities receiving HUD funding including the Community Development Block Grant are required to complete an Assessment of Fair Housing and annually certify that it will affirm further fair housing.

                     In March 2016, HUD published a new, final rule regarding the obligation to Affirmatively Further Fair Housing. The rule replaces the Analysis of Impediments to Fair Housing with an Assessment of Fair Housing (AFH). The AFH is an examination and determination of: 1) fair housing data, 2) assessment of fair housing issues, and 3) identification of fair housing priorities and goals for the implementation and use of the City’s HUD funds. An AFH report is the result of the analysis and conclusions.

                     Components of the AFH will include:

Review and analysis of distribution of local data (not just on housing and planning patterns, but also on schools, public and commercial services as well as transportation) to better assess issues and conditions that restrict fair housing choice;

 

Determine disparities to housing and opportunity of the local data and develop local strategy to resolve with those issues identified in the review and analysis of the data, to establish goals and fair housing priorities; and

 

Broad public participation that begins when the data is being collected and analyzed during the process, at the completion of the plan and allow for review to adjust planning for the future, as the city endeavors with other planning, including the Comprehensive Plan (McKinney 2040) and Emergency Disaster Planning.  Participation will include but not limited to the general public, governmental and non-governmental agencies, data providers, social service agencies and housing authorities.

 

                     The City of McKinney will monitor for compliance as a participant; coordinate its own local data contribution and a 30-day public comment period with two public hearings in McKinney; and coordinate citizen participation and communication resources.  Active input will be engaged - during the planning process when data is gathered and ready, and prior to the completion of the plan for public comment.  Participation will include the general public, data providers, assisted housing, fair housing agencies, organizations and public and private agencies that provide health services and social services including providers to children, elderly persons, persons with disabilities, homeless persons, and persons who may be underrepresented in public processes.

                     Staff has discussed with other cities in the Dallas-Fort Worth area how impacts and changes in land use, housing, and employment under regional planning can promote greater investment. Under discussion between the City and other Consortium participants, there is proposed consensus to coordinate to obtain The University of Texas at Arlington (“UTA”) to serve as the consultant to the proposed Consortium under contract with the City of Dallas.  Program Participants find that UTA’s support of the Consortium together with its strong relationships with each Program Participant and knowledge of the regional economy and housing market make UTA uniquely and ideally suited to help the Consortium develop a Regional AFH. 

                     Under the agreement, the City of Dallas (“Dallas”) will serve as the lead entity of the Consortium and will be responsible for submitting the regional AFH on behalf of the Consortium. Each Program Participant will appoint Dallas to act as its agent for purposes of hiring the consultant, leading Consortium efforts, and otherwise completing and submitting the Consortium’s regional AFH to HUD.  Dallas will negotiate the contract directly. The City will benefit in participation in this collaboration that includes the Collin County cities of Plano and Frisco.

 

FINANCIAL SUMMARY: 

 

                     The total project cost is $734,430. Cost contribution for the City of McKinney would be $4,231.  Cities of Plano and Frisco have agreed to participate. In past years, Collin County cities completed the Analysis with each city bearing costs and planning beyond the distribution list above.  Participation gains the benefit of resources, data, and impact that would be unmet or unmatched if the city completed this task on its own.

                     There is no impact to the General Fund.  Funding is under the approved allocation of FY 2016-17 Community Development Block Grant (CDBG), which is within the approved FY17 city budget. Calculations for all proposed participants was based on the cost percentage of each municipality’s CDBG or public housing authority’s HUD allocation for administration under the 2015 program year. The table below provides a comparable cost snapshot of city participants within Collin County areas.
