RECOMMENDED CITY COUNCIL ACTION:      
·      Approval of the Ordinance
 
ITEM SUMMARY:  
·      This ordinance amends the FY 2013-2014 annual budget by $3,930,068 for DR7158 (NRCS Dam Rehabilitation Site 2A), of which $917,318 is drainage construction fund balance and $3,012,750 is NRCS grant funding.
·      The 2014-2018 CIP plan is also amended by transferring project savings of $720,732 to DR7158 (NRCS Dam Rehabilitation Site 2A).
·      This proposed rehabilitation of Site 2A is authorized under Public Law 83-566, where the USDA-NRCS provides 65% of the funding ($3,012,750) needed to upgrade the dam and the local sponsor provides the remaining 35% ($1,622,250) and any permitting costs associated with the project ($25,000).  The total cost of the project will be $4,660,000.
·      A project agreement with the USDA-NRCS is also on this agenda.
·      The USDA-NRCS grant funding was programmed in FY 2014-2015 in the FY 2014-2015 CIP Plan under DR4241 (Dam Rehabilitation NRCS Lake 2A).  This ordinance brings forward the grant funding to the FY 2013-2014 budget year in DR7158 and eliminates the future DR4241 project.
·      The NRCS has accelerated the schedule and wishes to commence construction in September of 2014 and the funding from the City must be available prior to that time in order to secure the grant.
 
BACKGROUND INFORMATION:  
·      The dam was originally constructed in 1958 to capture sediment and provide flood control for adjacent farmland.
·      The dam has reached its useful life and needs to be upgraded to current safety and performance standards.  
·      The dam is situated on the future Highland Lakes development located east of Custer Road and north of Bloomdale Road as shown on the attached location map.  The lake is proposed to be a part of a future City park as stated in the Highland Lakes Development Agreement.
