RECOMMENDED CITY COUNCIL ACTION:      
·      Approval of Agreement
 
ITEM SUMMARY:  
·      This item authorizes a cooperative service agreement between the City of McKinney, North Collin Water Supply Corporation (NCWSC) and North Texas Municipal Water District (NTMWD) regarding water service during the early phases of development at Trinity Falls.
·      A companion "pass through" agreement between Trinity Falls, the City of McKinney and NCWSC is also on this agenda.
·      These two agreements would have been combined, but NTMWD only wanted to enter into agreements with their member and customer cities.
·      This cooperative service agreement essentially states NCWSC will provide the City of McKinney water at a point at the Trinity Falls development as shown on the attached exhibit.
·      A master water meter coming off the NCWSC system will be placed at the entry to Trinity Falls.
·      All water passing from NCWSC to Trinity Falls will be recorded at the master meter.  At and after the meter, the pipes and flow will be part of the City of McKinney's water system once accepted by the City.
·      In order for NTMWD to appropriately bill the City of McKinney for the water serving Trinity Falls, that master-metered flow will be read and provided to NTMWD as part of McKinney's water usage.
·      Meters for the individual residences in Trinity Falls will be City of McKinney meters, and the customers will be billed by the City of McKinney.
·      When sufficient demand exists in Trinity Falls to avoid excessive flushing, the 30" waterline will be constructed from the existing City system.
·      The meter will then be "reversed" where the City of McKinney provides a "pass-through" service point to NCWSC.  This service point will replace the existing service point (where McKinney can provide water to NCWSC) at Wilmeth Road and SH 5.
·      Trinity Falls, NCWSC and the City of McKinney all benefit from this agreement.
 
BACKGROUND INFORMATION:  
·      NCWSC has existing lines and customers in the vicinity of Trinity Falls.
·      The NCWSC system has some excess capacity, and NCWSC is agreeable to providing the City of McKinney water to serve the initial phases of the Trinity Falls development.
·      The Trinity Falls Development Agreement calls for very large diameter lines and an elevated storage tank to be installed.
·      During the initial phases of development, there will not be a significant water usage.  If the large lines were installed, this would create stagnant water concerns, and the City Water Department may be required to "waste" significant amounts of water to keep the system within TCEQ requirements.
·      Water flushing of up to 250,000 gallons per day may have been required if an agreement could not be reached where NCWSC would supply water.
·      NCWSC will/has approved the agreement on December 12, 2013.  NTMWD has placed the item on its agenda for January 23, 2014.
 
FINANCIAL SUMMARY:  
·      No negative financial impacts to the City of McKinney are anticipated due to the provisions of this agreement.
