RECOMMENDED CITY COUNCIL ACTION:      
·      Approval of the agreement.
 
ITEM SUMMARY:  
·      This item would allow the dedication and acceptance of parkland outside of the Parkland Dedication Zone that McKinney Urban Village is located within.   
 
BACKGROUND INFORMATION:  
·      McKinney Urban Village is a multi-family project approved for development at the southwest corner of State Highway 5 and SH 121.
·      With 245 units in this phase 4.9 acres of parkland are required.  The Subdivision Ordinance requires developers of residential projects to dedicate parkland at one acre for every 50 units.
·      The developer is proposing to dedicate approximately 8.166 acres (3.267 acres out of floodplain and 4.899 acres in floodplain).  When land is dedicated within a floodplain, its dedication requirement is at a 3:1 ratio rather than the 1:1 ratio for high and dry land.
 
·      Additionally, the land proposed to be dedicated is located generally at the northwest corner of Community Drive and future Bloomdale Road and is not within the development area of McKinney Urban Village.  
·      The Subdivision Ordinance requires that land dedicated or fees paid be within the same parkland dedication zone.  A facilities agreement is needed in order to accept a dedication that is within a different zone.  
·      The Parkland Zone Map is attached which shows how the City is geographically divided into the four distinct zones.  McKinney Urban Village is located within Zone 4 and the proposed land to be dedicated is within Zone 1.
·      The 8.166 acres are part of a larger open space area that Staff envisions becoming a regional park that will benefit the City as a whole.  With impending growth in the northwest section of the City, it is important now to preserve and establish open space and parkland when the opportunity is presented.  
·      The property is appealing from a Parks and Recreation perspective as it has varying topography, an NRCS Lake, mature tree canopy and multiple opportunities for hike and bike trail connections.  
·      Staff anticipates that the completion of acquiring the remainder of this green space will occur with the dedication requirements of several residential development projects that are in the planning stages. Attached is a conceptual plan titled McKinney Charette that portrays the vision of this area and what the open space area could look like.
