ITEM SUMMARY:  
·      This Resolution authorizes the Interim City Manager to execute a contract and all necessary change orders with Western Contracting for the Kings Lake Erosion Mitigation Project.
 
BACKGROUND INFORMATION:  
·      This project consists of installing a retaining wall behind 604 Kings Lake Drive to mitigate erosion caused by a large outfall pipe.
·      Pacheco Koch Consulting Engineers prepared the plans for this project.
·      Five bids were received for this project on December 18, 2014.  The following is a summary of the bids:

·      Western Contracting submitted the low bid in the amount of $275,389.00.
·      Western Contracting submitted references and qualifications that were verified in accordance with the bid specifications.
·      Western Contracting did have two minor irregularities in their bid. Staff determined that in accordance with the North Central Texas Council of Governments (NCTCOG) 2004 Edition of the Public Works Construction Standards, General Provisions, Item 102.10, the irregularities were not critical to the project and could be waived.  
·      City staff spoke with Western Contracting on December 23, 2014 regarding their construction methods for constructing the retaining wall.  City Staff and the Contractor determined that Western Contracting is capable of installing the wall for the price bid.
·      The authorized amount for construction includes a 15% contingency which is consistent with other drainage projects.  
·      The contract documents require that this project be completed within 120 days after issuance of a Notice to Proceed.  Since the project is sensitive to rainfall, City staff is working with the consulting engineer and the contractor to identify a window of time where rainfall amounts may be limited (based on forecasted and historic data) before issuing a notice to proceed.  
 
FINANCIAL SUMMARY:  
·      This resolution authorizes a contract and all necessary change orders with Western Contracting for an amount not to exceed $317,000.00.
·      With the approval of this item, there will be $5,573.00 left in the DR1205 account.
