RECOMMENDED CITY COUNCIL ACTION: 

                     Staff is recommending denial of the applicant’s appeal to remove original wood windows and install vinyl replacement windows.

 

                     However, if the City Council approves the applicant’s appeal to remove the original wood windows, Staff is requesting that the approval be conditioned as follows:

 

1. The applicant shall use replacement windows that retain the primary character-defining elements of the original windows, specifically including:

                     Wood frame

                     Exterior grills/grids

                     Matching four-over-one configuration

                     Matching clear glass

                     Matching size for window openings

                     Matching exterior profiles and exterior window trims

 

ITEM SUMMARY:

                     On October 7, 2010, the Historic Preservation Advisory Board (HPAB) of the City of McKinney voted 7 to 0 to deny a Certificate of Appropriateness (COA) to remove original wood windows and install vinyl replacement windows at 801 West Hunt Street.

 

                     Per Section 146-97(j)(3) of the “H” Historic Preservation Overlay District of the City of McKinney Zoning Ordinance, “any applicant or property owner aggrieved by a decision of the HPAB relating to economic hardship, demolition, or a certificate of appropriateness may, within 21 days of receipt of the written decision, file a written application with the City Council, through the Director of Planning, for review of the decision and the approval, denial, modification of, or deviation from, the HPAB’s decision. The City Council’s decision shall be final.”

 

                     As such, the applicant is now requesting an appeal of the decision by the HPAB to deny a COA to remove original wood windows and install vinyl replacement windows at 801 West Hunt Street.
