RECOMMENDED CITY COUNCIL ACTION:      
·      Staff recommends denial of the proposed rezoning request due to lack of conformance with Appendix B-2 (Regional Employment Center - Overlay Urban Design Standards) of the Zoning Ordinance.
 
·      However, should the proposed rezoning request be approved, the following special ordinance provision shall apply:
 
1.      The use and development of the subject property shall develop in accordance with the attached development regulations.
 
ITEM SUMMARY:  
·      The applicant is proposing to rezone approximately 142.04 acres of land generally to modify the development standards for single family residential (attached and detached) and multiple family residential uses.
 
·      The applicant has requested several modifications to the proposed single family detached residential uses, which includes increasing the required amount of internal open space, reducing the required offset between the building and the garage facades, removing the front porch requirement, reducing the side-at-corner and side yard setbacks, reducing the finished floor area, and increasing the maximum block length.
 
·      Prior to the City Council meeting, the applicant submitted a revised letter of intent with the modified special ordinance provision listed, allowing specific detached single family residential lots and attached single family residential lots (townhomes) less than 50 feet in width to have front-entry garages. Staff has concerns that a significant number of lots (particularly the townhome product) within the subdivision could be developed where the garage face is the primary feature of the first floor elevation, diminishing the aesthetic appeal of the dwelling units.
 
o      Alley access for rear yard or courtyard parking shall be required on each lot less than 50 feet wide except where (a) the lot backs onto (i) a usable open space of 0.5 acres or more, (ii) a commercial use or (iii) a single family residence with front entry garages, and (b) there is no garage facing the street on the opposing lot.
