APPROVAL PROCESS:  The recommendation of the Planning and Zoning Commission will be forwarded to the City Council for final action at the July 15, 2014 meeting.
 
STAFF RECOMMENDATION:  Staff recommends denial of the proposed rezoning request due to non-conformance with the Comprehensive Plan and the City's Multi-Family Policy.
 
However, should the rezoning request be approved, the applicant has requested the following special ordinance provisions shall apply:
 
1.      The use and development of the subject property shall develop in conformance with the "MF-1" - Multiple Family Residential - Low Density District of the Zoning Ordinance, except as follows:
 
a.      The development of the subject property shall generally conform to the attached site and landscape plan exhibits.
 
b.      Multi-family residential uses shall be limited to Multiple Family Dwelling, Senior (Senior Apartment), as defined in Section 146-46 (Definitions) of the Zoning Ordinance.
 
c.      Maximum building height shall be one (1) story.
 
d.      Windows within 150 feet of a property line shall be allowed to be oriented towards adjacent single family residences.
 
e.      A masonry screening wall shall not be required along all side and rear property lines.
 
f.      Existing residential fences or a new 6' tall board-on-board fence shall serve as a screening device between the proposed multi-family residential use and the adjacent single family dwellings. Alternate screening devices may be approved by the Planning and Zoning Commission as a part of the site plan approval process.
 
g.      A maximum of 44 dwelling units shall be permitted, as shown on the attached site plan exhibit.
 
h.      The character of any multi-family residential development shall generally conform to the attached elevations, shall satisfy the minimum architectural standards of the Stonebridge Ranch Master Association, and shall also be subject to Section 146-139 (Architectural and Site Standards) of the Zoning Ordinance, except as amended herein.

ITEM SUMMARY:  The applicant is requesting to rezone approximately 7.29 acres of land, generally to modify the development standards to develop the subject property for senior multi-family residential uses.  
 
In September of 2013, City Council approved a rezoning request (13-122Z) for approximately 5.25 acres of the subject property for senior multi-family residential uses (34 dwelling units). The applicant is now requesting to incorporate 10 additional senior multi-family dwelling units on approximately 2.04 acres along Alma Road.
 
The special ordinance provisions requested by the applicant are similar to the previously approved case including modification to architectural standards and  windows facing the existing single-family residential; with the only change being a clarification to the screening requirements and a revised layout to accommodate the additional dwelling units.
