RECOMMENDED CITY COUNCIL ACTION: Staff recommends approval of the proposed rezoning request with the following special ordinance provisions:
1. The use and development of the subject property shall follow the rules and regulations of Section 146-111 ("C1" - Neighborhood Commercial District) of the Zoning Ordinance, and as amended.
2. The use and development of the subject property shall not be subject to Appendix B-2 (Regional Employment Center - Overlay Urban Design Standards) of the Zoning Ordinance.
3. Buildings constructed on the subject property shall be finished with 100% masonry exterior finishing materials (brick, stone, or synthetic stone) per elevation, and shall conform to Section 146-139 (Architectural and site standards) of the Zoning Ordinance.
4. A minimum 12 foot wide landscape buffer shall be provided along the southern property line of the subject property.
5. A 6' tall masonry wall shall be required along the southern and western property lines of the subject property.
ITEM SUMMARY:
· The applicant is requesting to rezone approximately 2.37 acres of land from "AG" - Agricultural District to "PD" - Planned Development District generally to allow for a memory care facility (Avalon Homes Memory Care).

BOARD OR COMMISSION RECOMMENDATION:
· On April 14, 2015, the Planning and Zoning Commission voted 7-0-0 to recommend approval of the rezoning request. At the Planning and Zoning Commission meeting, the applicant indicated a masonry wall would be provided along the southern and western property lines, where adjacent to single family residential uses. Subsequent to the meeting, the applicant requested an additional special ordinance provision requiring a masonry wall at these locations, which has been provided in the list of special ordinance provisions above. Staff is supportive of the additional special ordinance provision.
