RECOMMENDED CITY COUNCIL ACTION: Approve Ordinance calling for a Special Election, as required by state law.
ITEM SUMMARY:
• A Special Election to Fill the Vacancy of City Council Member At-Large #2 will be Saturday, January 15, 2022, with additional days provided for Early Voting.
• Qualified candidates for the election must meet the same eligibility requirements as normal election candidates. Applications may be submitted to the City Secretary Office beginning November 3 until November 12, 2021 (8:00 a.m. to 5:00 p.m. on weekdays, and 8:00 a.m. to 1:00 p.m. Saturday and Sunday).
• A drawing for the order of names to appear on the ballot will be conducted publicly on Monday, October 15, 2021, 9:00 a.m. at City Hall Council Chambers, 222 N. Tennessee Street, McKinney, Texas 75069.
• The notice of this election will be posted on the City Hall bulletin board, posted online on the city Elections webpage, and published in the McKinney Courier Gazette / Celina Record newspapers in accordance with Texas Election Code requirements.
• The election results will be canvassed between January 18-26, 2021, in accordance with Texas Election Code requirements.
• This Ordinance provides for the following:
o Appointment of an Early Election Voting Clerk: Bruce Sherbet, Collin County Elections Administrator

BACKGROUND INFORMATION:
• On October 15, 2021, Council member Frederick Frazier, who was serving a four-year term as Council member At-Large #2, announced his candidacy for another elective office, thereby automatically resigning his office by operation of law with more than twelve (12) months remaining in his term (Texas Constitution Art. 11, Sec. 11(c); Art. 16, Sec. 65(b)
• The City Council must call an election that will be held within one hundred (120) days of the vacancy occurrence.
• Council Member Frazier will continue the duties of office until a new member is confirmed.
FINANCIAL SUMMARY:
• The city’s cost for this election will be approximately $187,000 including a contract with the Collin County Elections Administration; translation services; publication and distribution of voter information, advertisements, and legal notices.
• $70,000 were allotted for election expenses in the FY22 budget; Operational Contingency funding will cover the remaining balance.
