RECOMMENDED CITY COUNCIL ACTION:      
·      Staff recommends denial of the proposed rezoning request due to lack of conformance with Section 146-139 (Architectural and Site Standards) of the Zoning Ordinance and the City of McKinney Comprehensive Plan.
 
·      However, the applicant is requesting approval the following special ordinance provisions:
 
1.      Use and development of the subject property shall conform to "PD" - Planned Development District Ordinance No. 2011-01-002, and as amended, except as follows:
 
a.      A maximum of 13 portable buildings be allowed on the subject property generally in the locations shown on the attached site layout.
 
b.      Gates shall generally be placed in the locations shown on the attached fence exhibit.
 
c.      Eight (8) Knock Out Rose shrubs and eight (8) Holly shrubs (2 feet at time of planting, placed 3 feet on center) will be planted along the south of the two proposed portable buildings.
 
d.      Two (2) Crepe Myrtle trees (spaced 10 feet apart, 5 feet tall, 2 inches in caliper at time of planting) and 8 Knock Out Rose shrubs (2 feet at time of planting, placed 3 feet on center) will be planted along the west side of the proposed storage building, shown on the attached site layout.
 
ITEM SUMMARY:  
·      The applicant is requesting to rezone approximately 59.96 acres of land, located on the south side of Bois D'Arc Road and approximately 800 feet west of Jordan Road from "PD" - Planned Development District to "PD" - Planned Development District, generally to modify the development standards. The site is currently home to the McKinney Christian Academy and has 11 portable buildings and 6 permanent buildings on site. The applicant is requesting to install 2 additional portables, increasing the total number of portable buildings to 13. It is the applicant's intent that these portable buildings be allowed to remain indefinitely on the property.
 
·      At the February 11, 2014 Planning and Zoning Commission meeting, one resident spoke in opposition to the rezoning request, stating concerns about the temporary structures, uncontrolled growth, and traffic issues (see attached minutes). Subsequent to the meeting, this resident submitted a letter of opposition with photos of the site (see attached letter with photos).
 
·      At the March 4, 2014 City Council meeting, the City Council tabled the item to the March 18, 2014 meeting to allow City Staff to address City Council concerns with the applicant. Subsequent to the March 4th City Council meeting, members of the Planning and Engineering Departments observed McKinney Christian Academy's pick-up and drop-off process on two occasions (Wednesday, March 5th, and Thursday, March 6th) in order to identify opportunities for improvement. During those observations, City Staff identified normal amounts of automobile stacking within the public right-of-way. Staff also contacted the Head of Schools for McKinney Christian Academy to identify opportunities for circulation improvements. The Head of Schools indicated that there has not been any noticeable stacking or parking in the right-of-way since staggered pick-up and drop-off times were introduced in August of 2013. Because the issue of automobiles parking or stacking in the right-of-way appears to have been eliminated several months ago, no changes to McKinney Christian Academy's pick-up or drop-off processes are needed or recommended. That said, City Staff will continue to monitor traffic congestion and speeds in the area and will take any reasonable steps to mitigate any issues that may arise in the future.
