RECOMMENDED CITY COUNCIL ACTION:

                     Approval of the Resolution.

 

ITEM SUMMARY:

                     This Resolution authorizes the City Manager to enter into an Interlocal Agreement with McKinney Municipal Utility District No. 1 of Collin County (“District”) for the Trinity Falls East Feed Water Line and Redbud Pump Link and to provide funding associated with the construction of the McLarry 36-inch master-planned water line from the Redbud Pump Station to Bloomdale Road (CIP Project WA2052).

 

BACKGROUND INFORMATION:

                     Trinity Falls Holdings LP (“Trinity Falls”), an entity controlled by The Johnson Development Corp., is the assignee and successor-in-interest to CH-B Trinity Falls, LP, and is developing property pursuant to the 2012 Development Agreement, as currently amended, between CH-B Trinity Falls, LP and the City with the original effective date of December 4, 2012 (“Development Agreement”).

                     Per the development agreement, Trinity Falls is required to construct water distribution lines (per the City of McKinney Water Master Plan) designated and identified as the “East Feed Water Line” that contains approximately 8,168 linear feet of twenty-four-inch (24”) diameter water line plus approximately 6,404 linear feet of thirty-six-inch (36”) diameter water line extending between its northern terminus at the “Trinity EST” on Weston Road along and about Trinity Falls Parkway, Laud Howell Parkway, U.S. 75, and McClarry Road to its terminus at the northern boundary of Bloomdale Road as provided in “Exhibit A” of the interlocal agreement (ILA).

                     The City is required by the Development Agreement to construct and install the water lines required to deliver an adequate supply of water from the Redbud Pump Station to the north side of Bloomdale Road (referred to as CIP Project WA2052, “McLarry Water Line” and “Redbud Pump Link”) as shown on the City's Water Master Plan to deliver adequate water supply to the City system to the extent necessary to provide uninterrupted water service to the development.

                     Kimley-Horn and Associates, Inc. has prepared the construction plans for CIP Project WA2052 (“McLarry Water Line”).

                     Project WA2052 (“McLarry Water Line”) consists of approximately 2,582 linear feet of 32-inch master planned water line connecting the Districts planned water-line to the newly constructed Redbud Pump Station.

                     This Interlocal Agreement will allow the City obligated portion of the master-planned water improvements (CIP Project WA2052, “McLarry Water Line”) to be constructed as part of construction contract for the District obligated portion of the master-planned water improvements (“East Feed Water Line”).

                     Under this Interlocal Agreement, the District will assume responsibility for construction of the City’s project (CIP Project WA2052, “McLarry Water Line”) in exchange for the City’s payment of the costs associated for those improvements.

                     The City will pay the District for costs associated with the City’s project in payment draw requests based on actual costs incurred through project acceptance which has been established $1,899,251.00 plus or minus any additive or deductive change orders approved by the City.

                     The District has received bids and entered into a contract for both projects with Belt Construction of Texas, LLC as the lowest qualified bidder.

                     Construction of the master-planned water improvements is expected to commence in July 2021 and is anticipated to be completed within 300 calendar days (April 2022).

 

FINANCIAL SUMMARY:

                     The City participation amount of $1,899,251.00 is available in Capital Improvements Project WA2052, McLarry Water Line.

                     Upon approval of this agreement, $1,025,549 will remain in Project WA2052.

                     Additional funding available in Capital Improvements Project WA2052 will be utilized in the event unforeseen additive change orders are required (increasing the City’s total participation amount).
