RECOMMENDED CITY COUNCIL ACTION:      
Approve the attached Ordinance adopting the 2012 International Property Maintenance Code as the property maintenance code for the City of McKinney, Texas.
 
ITEM SUMMARY:  
 
Chapter 122 changes -
·      The Building Inspection department conducted the 2013 and 2014 annual Multi-family and Hotel/Motel property inspections under the adopted 2003 International Property Maintenance Code and recommends the adoption of the 2012 International Property Maintenance Code to ensure that current codes are consistently applied and quality inspections are performed on all buildings.
 
Chapter 126 changes -
·      The Housing and Substandard Structures referenced code is currently the 1994 Uniform Code for the Abatement of Dangerous Buildings. The proposed change of referenced code to the 2012 International Property Maintenance Code will also ensure that current codes are consistently applied and quality inspections are performed on all buildings identified as substandard structures.
 
 
BACKGROUND INFORMATION:
 
·      The City of McKinney adopted the International Code Council's full set of 2012 International Codes on July 16, 2013 which applies to all construction under permit requirements in the city.
Chapter 122 -
·      The annual Multi-family and Hotel/Motel inspection program was established in February of 2002, under Chapter 122 of the Code of Ordinances, to ensure that these types of occupancies were inspected for minimum life-safety provisions.
 
·      The City of McKinney adopted the 2003 International Property Maintenance Code in April of 2005, as the property maintenance code under the established Multi-family and Hotel/Motel annual inspection program.
 
·      The exterior of each multi-family and hotel building and property is inspected annually. The interior of any multi-family dwelling unit and hotel/motel unit may be inspected upon request of the owner, yet if the resident requests an interior inspection, the owner permission must be submitted to the city in writing or by the owner accompanying the inspector and occupant for the inspection of the interior of the dwelling unit.
 
·      To date, there are 62 Multi-family complexes containing 744 individual buildings and 10,903 individual dwelling units. To date, there are 12 Motel/Hotels containing 15 individual buildings with 923 individual lodging units.
 
Chapter 126 -
·      The City of McKinney adopted the 1994 Uniform Code for the Abatement of Dangerous Buildings as the minimum standards code per ordinance update in 2009. This code is no longer published and has evolved into the 2012 International Property Maintenance Code.
 
SPECIAL CONSIDERATION:
·      City staff conducted a code change evaluation from the 1994 Uniform Code for the Abatement of Dangerous Buildings and the 2003 International Property Maintenance Code to the 2012 International Property Maintenance Code and determined that there are no significant changes that would affect the property owners or reduce the life safety intent. The changes and updates only reflect clarifications to the inspection procedure and code application locations.
 
·      The Building Inspection department is currently conducting the annual multi-family and hotel/motel inspections with current staff, yet there is no annual registration and inspection fee to cover the program labor costs. Staff will be evaluating a registration and fee proposal for the 2015-2016 budget process.
