RECOMMENDED CITY COUNCIL ACTION:      
·      Staff recommends approval of the proposed rezoning request with the following special ordinance provision:
1.      The use and development of the subject property shall develop in accordance with the attached development regulations.
 
However, the applicant has proposed an alternate parking ratio in the attached development regulations with which Staff is recommending denial of.
 
ITEM SUMMARY:  
·      The applicant is requesting to rezone approximately 10.25 acres of land, located on the northeast corner of U.S. 380 (University Drive) and Grassmere Lane from "PD" - Planned Development District, generally for mixed use and neighborhood business uses, to "PD" - Planned Development District, generally to allow for the development of single story, detached, multifamily dwelling units, and to establish the standards necessary for the development of the product.
 
·      At the April 22, 2014 Planning and Zoning Commission meeting, two residents voiced concerns about the item regarding whether or not the development would be compatible with the Tucker Hill subdivision, impact on property values, traffic issues, and parking issues (please see attached minutes).

BOARD OR COMMISSION RECOMMENDATION:
·      On April 22, 2014, the Planning and Zoning Commission voted 4-2-0 to recommend approval of the rezoning request as recommended by Staff, with exception of a change to the requested parking ratio and an additional special ordinance provision regarding a deceleration lane discussed further below.
 
·      The Planning and Zoning Commission recommended a special ordinance provision for the dedication of right-of-way for and construction of a deceleration lane along U.S. Highway 380 (University Drive) to Grassmere Lane. The applicant indicated at the meeting that they would be willing to provide the deceleration lane to try to lessen traffic concerns generated by the development and thus was included in the motion.
 
·      The Planning and Zoning Commission also recommended a modified parking ratio of two (2) parking spaces per unit with one space being fully enclosed. Subsequent to the Planning and Zoning Commission meeting, the applicant provided a letter to Staff stating that they were uncomfortable moving forward with the parking ratio recommended by the Commission and has proposed a new standard for parking (see attached letter from the applicant). As such, Staff has provided the Council with two versions of Zoning Exhibit E (Development Regulations) differentiating the Planning and Zoning Commission's recommendation for the parking ratio and the applicant's newly requested parking ratio (see attached).
