ITEM SUMMARY:
·      This Resolution authorizes the Interim City Manager to execute a contract and all necessary change orders with Accelerated Critical Path, Inc (ACP, Inc.) for the rehabilitation of Floodwater Retarding Structure Site 2A in the East Fork above Lavon Watershed.

·      Accelerated Critical Path, Inc. submitted the low bid in the amount of $3,641,789.50.

·      Accelerated Critical Path, Inc. submitted references and qualifications that were verified.

·      The NRCS, along with City staff spoke with representatives from ACP, Inc. via conference call the afternoon of October 20, 2014 and agree that ACP is capable of performing the rehabilitation work.
·      This project included an alternate bid using irrigation water from a municipal source.  Since the City is currently in a drought, the base bid (irrigation water from an alternate source) will be used for award.  However, the alternate bid item price may be used for irrigation water if the watering restrictions change when it is necessary to irrigate the dam.
·      The authorized amount for construction includes a 15% contingency which is consistent with other NRCS rehabilitation projects.
·      The contract documents require that this project be completed within 494 calendar days after issuance of the Notice to Proceed, which is expected in November.  Construction is expected to be complete in March 2016.

FINANCIAL SUMMARY:
·      This resolution authorizes a contract and all necessary change orders with ACP, Inc. for an amount not to exceed $4,188,000.

·      Funds totaling $4,665,800 have been allocated to DR7158.  The sources for these funds are as follows:
o      NRCS - $3,012,750
o      City - $1,653,050

·      The NRCS is reimbursing 65% of the project costs:
o      The current City portion (35%) of those costs is $1,368,300.
o      $1,503,050 of City funds in DR7158 have been allocated to construction, which will leave an excess of $134,750 in the account.
o      If the Texas State Soil and Water Conservation Board grant of $655,000 on this agenda is accepted, the City's portion of construction costs will be reduced to $713,300.
