RECOMMENDED CITY COUNCIL ACTION:      
·      Approval of the Ordinance.
 
ITEM SUMMARY:  
·      Through an associated Interlocal Agreement (ILA), the cities of McKinney, Frisco and the Frisco Independent School District are working on a joint project that will create an alternative route that is more direct for the students of Mooneyham Elementary School living in the subdivisions to the south by constructing pedestrian walkways and a pedestrian bridge over an existing drainage swale through Ash Woods Park.
 
·      An accompanying Resolution to enter into this ILA is also on this agenda for Council's consideration.
 
·      McKinney and Frisco will each construct the public improvements within their respective cities. FISD's contribution will consist of funding ½ of the estimated project costs for each city, as spelled out in the ILA.  
 
·      McKinney will be responsible for constructing approximately 150' of a concrete walkway and installing an approximately 60' long pedestrian bridge. This portion of the project is estimated to cost $160,000, of which FISD will reimburse the City $80,000. This leaves McKinney's estimated portion at $80,000.  
 
·      Staff recommends adding a 10% contingency to the overall project budget which would bring the amount of funding requested to $96,000.
 
·      This Ordinance amends the FY2013-2014 annual CIP budget and the 2014-2018 Capital Improvement Program, by transferring $96,000 from the Parkland Dedication Zone 3 Fund to the Parks Construction Fund and to setup a new CIP project PK4368 Ash Woods Park Hike and Bike Trail Bridge Project.
 
BACKGROUND INFORMATION:  
·      The City of McKinney, City of Frisco and the Westridge subdivision developer initiated discussions on an agreement regarding the placement of a pedestrian bridge over a drainage swale connecting the HOA property through Ash Woods Park to Mooneyham elementary School.
 
·      In August 2012, Frisco ISD terminated bus service within two miles of Mooneyham elementary School. McKinney and Frisco residents who are within sight of Mooneyham Elementary School were subsequently inconvenienced with a circuitous concrete route to school which encouraged students to cross the drainage swale as a short cut.
 
·      The City of Frisco and the City of McKinney Legal Departments have both counseled that bridge placement does not unnecessarily expose the cities to liability issues subsequent to concrete trail placement.
 
FINANCIAL SUMMARY:  
·      The attached financial summary details the transfer of funds in the amount of $96,000 from the Parkland/Median Fee Fund (Parkland Dedication Zone 3) to the Parks Construction Fund and appropriating $80,000 for ISD Contributions and to setup a new CIP project PK4368 Ash Woods Park Hike and Bike Trail Project.
