ITEM SUMMARY:  
·      This item authorizes the City Manager to enter into a lease agreement with Plano Sports Authority (PSA) regarding the lease of a portion of Gabe Nesbitt Park and the construction of certain site improvements to the park.
·      The agreement provides for PSA to lease the property and to construct, own, maintain and operate a multi-purpose indoor athletic facility, including offices, and other multi-use indoor spaces.
·      The agreement also spells out the responsibilities of both the City and PSA regarding construction of both public and private facilities and infrastructure.
o      On December 17, 2013 the City Council approved an ordinance amending the Fiscal Year 2014 Annual Budget to provide funds for Gabe Nesbitt Park infrastructure improvements.
o      A total amount of $1,840,000 was transferred into a new CIP project named Gabe Nesbitt Park Infrastructure Improvements (CO4271).
o      This CIP project includes site utilities, landscaping, irrigation, lighting, drainage (including retention/detention), franchise utilities, sidewalks and other site improvements to the park necessitated by the upcoming construction of the City of McKinney Aquatic Center and the PSA Center, both of which will be located in the northern portion of the park.
o      PSA desires to have an operational facility prior to the beginning of fall basketball season which begins on December 1, 2014.
o      Due to the short time frames involved with the construction of the project and the difficulties associated with having the City's infrastructure project being constructed simultaneously on and around the same property as PSA's project, it was determined that all improvements should be constructed under a single contract administered by PSA.
o      The City will reimburse PSA for those items installed that are the responsibility of the City.  
 
BACKGROUND INFORMATION:  
·      PSA is an independent, non-profit corporation with a charter to provide youth sports to the area.
·      Per their website, Plano Sports Authority provides year-round recreational sports leagues to all boys and girls who live within the School District and surrounding areas.  At their other facilities, the volunteer base of Sports Directors and coaches offers several different sports to over 60,000 kids annually.  Those sports include: martial arts, football, baseball, softball, volleyball, basketball, cheerleading, track, drill team, summer camps, soccer, and rugby.
 
FINANCIAL SUMMARY:  
·      Staff is of the opinion that the use of a single contractor for the infrastructure work on and around Gabe Nesbitt Park will lead to a significant time and cost savings on the project.
o      The City's maximum out of pocket expenses on this project shall not exceed $1.81 million.
o      A preliminary estimate of the costs for the City's portion of the project is $1.45 million.  
o      The lease agreement requires that PSA provide a preliminary budget within 60 days from the effective date of the agreement.
