RECOMMENDED CITY COUNCIL ACTION:
• Approval of the Resolution.
ITEM SUMMARY:
• This Resolution authorizes a contract amendment with Kennedy Consulting, Ltd. (KCI) to provide additional engineering services related to the Alma Road and Silverado Trail project, for a revised fee not to exceed $300,000.
BACKGROUND INFORMATION:
• An Engineering Services Agreement with KCI was authorized by City Council on June 7, 2011, for an amount not to exceed $250,000. The contract amount was increased to $275,000 for additional services related to storm drain design on September 20, 2011.
• KCI has developed construction plans for the Alma Road and Silverado Trail project, in accordance with the design contract and current City design guidelines.
• The project is scheduled for completion prior to the opening of Comstock Elementary (FISD) in August.
• The project schedule is contingent upon a clear ROW for construction operations and staff is currently negotiating the acquisition of right-of-way necessary for the project.
• The property at the southeast corner of Alma Road and Silverado Trail has a building with a conditioned space that has been finished out with a kitchen, restroom and office space for the operation of the business.
• This building will be impacted by the current design and will need to be removed and a new building will need to be constructed as a replacement building in order to complete the project as designed.
• An alternative roadway layout has been developed that would allow the building to remain in its current location, as a temporary solution.
• This roadway layout involves the construction of the two eastbound lanes in a temporary alignment, shifting them to the north and into the area where a raised median would typically have been constructed. The westbound lanes are not affected by this shift.
• This solution has the following advantages:
o The removal and reconstruction of the existing building would be a significant inconvenience to the property owner and upon completion the use of the buildings would be diminished by the reconfiguration. With the alternate design this will not need to occur.
o The current use is not the highest and best use for this property and as development occurs in the future the buildings will be removed.
o The City will save the cost associated with the construction of a new building that would need to be removed when the property is developed.
o The temporary roadway alignment includes an offset that does not meet the criteria for permanent street design; however, the inconvenience to the motorist using the altered alignment will be tolerable during the interim period.
o As the tract develops the right-of-way required for the ultimate street alignment will be provided by the owner/developer of the tract through the platting process and the permanent eastbound lanes will be constructed by the developer in the alignment that conforms to the street design criteria.
o We have recently been informed of a property ownership dispute that further complicates the issue which would likely result in a significant delay to the removal and replacement of the building.
o This scenario is less expensive than the current plan that involves constructing a new building that will ultimately need to be removed.
• To move forward with this solution, additional design services are needed to modify the construction plans and revise the acquisition documents.
• KCI has provided a proposal in the amount of $20,941.40 for these additional services.
FINANCIAL SUMMARY:
- This Resolution authorizes a revised contract with KCI for an amount not to exceed $300,000.
- Funding for this contract is included in the Capital Improvements Program ST9114.
