RECOMMENDED CITY COUNCIL ACTION:                     

                     Staff recommends approval of the proposed ordinance.

 

ITEM SUMMARY: 

                     Staff received a request from the adjoining property owner (HRC WCD Partners, LP) to abandon a portion of the right-of-way for Bloomdale Road located approximately 150 feet west of Ridge Road and on the north side of Bloomdale Road.

                     No other property owners are directly adjacent to the abandoned right-of-way other than the applicant.

                     This same property owner dedicated the right-of-way with the plat for Highland Lakes Phase 1 filed in July 2023, in accordance with the then-effective Master Throughfare Plan.

                     Since that time, TxDOT has established the final alignment of the US 380 Bypass and the City has modified the Master Thoroughfare Plan accordingly to show a new alignment of Bloomdale Road further south.

                     This segment of Bloomdale Road is no longer proposed to be an arterial roadway in the future; the City will retain a portion of the right-of-way needed for a two-lane collector roadway but agrees to abandon the excess portion of the right-of-way back to the adjoining property owner.

                     The adjoining property owner will replat the abandoned right-of-way in the future and include it with their developable acreage for a future commercial development at the corner of Ridge Road & Bloomdale Road / US 380 Bypass.

                     The right-of-way to be abandoned consists of an area 30 feet wide and 572 feet long and containing approximately 0.362 acres.

                     A Utility Easement shall be retained by the City of McKinney for the benefit of all public utilities over the entirety of the abandoned right-of-way.

                     Public hearing notices were sent to all property owners within 200 feet of the requested abandonment, and a legal notice was published in the McKinney Courier-Gazette. As of August 12, 2024, staff has received no comments in support of or opposition to this request.

 

BACKGROUND INFORMATION: 

                     The adjoining property owners previously entered into a Facilities Agreement for Roadway Impact Fee credits associated with the dedication of this right-of-way. An amended agreement to reduce Roadway Impact Fee credits available to the adjoining property owners will be presented to City Council for approval at the September 6, 2024, meeting.
