APPROVAL PROCESS:  The Planning and Zoning Commission is the final approval body for this concept plan per the PD.

ITEM SUMMARY:  The applicant proposes a potential layout for Lot 5 of the Shops at Eagle Point as required under “PD” - Planned Development District Ordinance No. 2002-05-048.  A rental car facility, specifically Enterprise Rent-a-Car, is proposed for the undeveloped lot and is permitted under the approved zoning.  According to the ordinance, major drives shall not have parking backing onto them unless specifically approved during the concept plan review process.  Because the proposal requires that parking spaces back onto main drives, the applicant has submitted a revision to the approved concept plan for consideration.

 

PLATTING STATUS:  The subject property is currently platted as Lot 5 of the Shops at Eagle Point Addition. Subsequent to the approval of a preliminary-final replat, a record plat, subject to review and approval by the Director of Planning, must be filed for recordation with the Collin County Clerk, prior to issuance of a certificate of occupancy

 

CONCEPT PLAN: Under the governing base planned development ordinance, a concept plan is required if the development of the entire zoning area is not shown on a single site plan.  A zoning area is a tract of land or contiguous tracts of land under the same zoning district. The subject property is currently zoned “PD” Planned Development for commercial uses. The governing ordinance stipulates that concept plans be reviewed by the Planning and Zoning Commission as the final approving body.

 

The purpose of a concept plan is to set forth the development objectives allowed under zoning criteria in a graphic or specific written manner. The approved concept plan (06-413CSP) showed the subject property could be effectively developed with two buildings hosting a mix of restaurant and retail uses, and specified other areas as “Future Pad Sites,” as long as basic access and circulation needs were planned for the overall parcel as a whole. As each site on the plan was developed, a site plan would be required. However, parking areas were not shown backing to the main drives. The attached revised concept plan displays the proposed lot layout for the development and indicates Lot 5 will be developed as a rental car facility use with parking spaces backing onto a main drive, which requires approval from the Planning and Zoning Commission.

 

Staff does not have concerns that the request will have a detrimental effect on the development or traffic patterns as a whole and as such recommends approval of the request.

 

While the proposed concept plan lays out the anticipated use of Lot 5, any future development of the subject property will be subject to all applicable City Ordinances, including but not limited to the Zoning Ordinance (i.e. land use and development regulations) and the Subdivision Ordinance (i.e. platting). Proposed concept plans as approved shall not allow for deviations to applicable City Ordinances.
