RECOMMENDED CITY COUNCIL ACTION:
• Approval of the Resolution.
ITEM SUMMARY:
• This Resolution authorizes the City Manager to execute a contract in the amount of $117,860, with Freese & Nichols, Inc. for professional consulting engineering services to assist the City in completion of a Risk and Resilience Assessment as required by the America’s Water Infrastructure Act of 2018, for a total aggregate contract amount, inclusive of any supplemental agreements, not to exceed $130,000.
BACKGROUND INFORMATION:
• On October 23, 2018, the America’s Water Infrastructure Act (AWIA), Public Law No: 115-270 was enacted and establishes new risk and resilience requirements for Community Water Systems (CWSs).
• Section 2013 of AWIA amends Section 1433 of the Safe Drinking Water Act (from the 2002 Public Health and Bioterrorism Response Act) and requires all CWSs serving more than 3,300 people to conduct Risk and Resilience Assessments to include the risk to the system from malevolent acts and natural hazards.
• The AWIA also requires CWSs to update their Emergency Response Plans to include items that incorporate the findings of the assessment.
• For all water systems that serve over 100,000 population, the AWIA establishes a deadline of March 31, 2020 for certification to EPA that a Risk and Resilience Assessment has been completed and a deadline of September 30, 2020 for the update of their Emergency Response Plans.
• In August of this year, the EPA provided “guidance” to meet established deadlines to CWSs.
• Freese and Nichols, Inc. submitted a response to RFQ 18-46 for On-call Utility Design Services. They were one of eleven firms shortlisted by City Council on October 2, 2018.
• Staff has negotiated a project proposal with Freese and Nichols, Inc. in the amount of $117,860 and scope of work was developed to assist the City in meeting the EPA’s minimum requirements of the AWIA Risk and Resilience Assessment.
• Staff is recommending a 10% contingency for the project in the event that additional services are deemed necessary at a later date.
• Upon completion of the risk assessment, staff will utilize the findings from the assessment to determine the next phase that will involve evaluating and revising the Emergency Response Plan accordingly.
FINANCIAL SUMMARY:
• This Resolution authorizes a contract with Freese & Nichols, Inc. for an amount not to exceed $130,000.
• Funds are available in the Public Works Department’s Water Distribution Professional/Contract Services Account and the Water Distribution Infrastructure Maintenance Account, 003-503-8205-8516 and 003-503-8205-8307.
