RECOMMENDED CITY COUNCIL ACTION:      
·      Staff recommends denial of the proposed rezoning request due to lack of conformance with the City Council's goal of preserving and developing the non-residential tax base.
 
However, should the rezoning request be approved, the applicant is requesting approval of the following special ordinance provisions:
 
1.      The use and development of the subject property shall develop in accordance with the attached development regulations.
 
2.      The development of the subject property shall generally conform to the attached concept plan exhibit.
 
3.      The attached site layout may not be constructed until all Engineering regulations have been satisfied, subject to review and approval by Director of Engineering.
 
Staff's professional opinion is that the subject property's location and topography are fairly conducive for residential uses and the proposed townhome use can serve as an appropriate transition between the future commercial to the north and the single family residential subdivision to the south.
 
ITEM SUMMARY:  
·      The applicant is requesting to rezone approximately 12.72 acres of land for 40 townhomes, located approximately 600 feet south of Virginia Parkway and on the east side of Hardin Boulevard, from "PD" - Planned Development District, generally for office uses, to "PD" - Planned Development District, generally for  single family attached residential (townhome) uses. Additionally, the applicant has provided a concept plan exhibit that will govern the development of the subject property.
 
·      At the March 25, 2014 Planning and Zoning Commission meeting, the Commission voted 7-0-0 to table the rezoning request to the next meeting in order to give the applicant time to address some of the surrounding neighbors' concerns. At that time, the applicant's request consisted of rezoning the property to allow for single family detached residential uses, generally on 40-foot wide lots with front-entry garages.
 
·      At the April 8, 2014 Planning and Zoning Commission meeting, the Commission voted 6-0-0 to table the rezoning request indefinitely per the applicant's request.
 
·      Prior to the July 22, 2014 Planning and Zoning Commission meeting, the applicant revised the rezoning request from a 40-foot wide, single family detached residential product to a 25-foot wide, single family attached residential (townhome) product, both with front-entry garages. At the meeting, the Commission voted 6-0-0 to table the rezoning request indefinitely per the applicant's request.
 
·      At the August 26, 2014 Planning and Zoning Commission meeting, the Commission voted 3-2-0 to recommend denial of the proposed rezoning request.
 
·      At the September 16, 2014 City Council meeting, the Council tabled the item indefinitely in order for the applicant to address Council's concerns regarding an alley-served townhome product and associated architectural standards. Due to the extent of the changes made to the concept layout to accommodate alleys, this request is being heard again by the Planning and Zoning Commission and the recommendation of the Commission will be forwarded to the City Council for final consideration at the November 4, 2014 City Council meeting.
 
·      Prior to the October 14, 2014 Planning and Zoning Commission meeting, the applicant revised the rezoning request from a front-entry townhome product to an alley-served, rear entry townhome product, with additional provisions regarding architectural elevations, landscaping, entry design, and open space requirements.
