RECOMMENDED CITY COUNCIL ACTION:
· Consider Ordinance and provide direction for Staff
ITEM SUMMARY:
· This Ordinance renames Millerd Pond Drive to Millard Pond Drive from Rosebury Circle to Stonebridge Drive.
BACKGROUND INFORMATION:
· In August 2001, Millerd Pond Drive within Saddlehorn Ridge Phase 1 was dedicated by plat to the City of McKinney, which is the portion east of Stonebridge Drive.
· In November 2001, Millerd Pond Drive within Wyndsor Grove was dedicated by plat to the City of McKinney, which is the portion just west of Stonebridge Drive extending from Stonebridge Drive to Glendevon Drive.
· In December 2001, Millard Pond Drive within Stratford Manor Addition was dedicated by plat to the City of McKinney which extends from Glendevon Drive to Rosebury Circle. This dedication extended the existing Millerd Pond Drive, west of Stonebridge Drive.
· In November 2002, Millard Pond Drive was changed to Millerd Pond Drive by Ordinance No 2002-11-110 as the street name was inadvertently misspelled on the Stratford Manor Addition plat.
· The Central Appraisal District of Collin County, the Collin County Elections Department, the United States Postal Service, Emergency Services, and the Utility Billing were informed to correct the spelling of the street in Stratford Manor Addition to Millerd Pond Drive.
· Beginning in 2003, the homes were constructed along Millerd Pond Drive. The builder for the Stratford Manor Addition constructed stone façades on the front of each house with the address using the name Millard Pond Drive.
· The residents of Stratford Manor Addition along Millerd Pond Drive have requested that Millerd Pond Drive from Rosebury Circle to Stonebridge Drive be renamed to Millard Pond Drive. The residents state mail gets lost, that motorists are confused by the street name being different than the name on the house façade, and the original Plat with the misspelled street name is still filed at the Collin County offices creating a title issue.
· The United States Postal Office stated that whether the address on the parcel was spelled Millerd Pond or Millard Pond, the mail parcel would have been delivered. If any mail was lost, it was not a function of the spelling of Millerd Pond/Millard Pond.
· The electronic mapping systems such as Google show the name of the street to be Millerd Pond Drive. By changing the name to Millard Pond Drive would create two names for the same roadway potentially causing confusion or may eliminate the possibility of locating the street on a mapping system. Past experience shows it can take years to update the mapping systems, which would become a huge burden to existing homeowners.
· Emergency Services has expressed a major concern about the potential confusion during an emergency call that could lead to a life/death situation if a roadway does not maintain a continuous name along its entire length and bears two separate names instead.
If Council would like to keep the name as Millerd Pond Drive
· In order to correct the title issues experienced at Collin County with the misspelled street name, a Certificate of Correction can be filed with Collin County. A Certificate of Correction will be attached to the original plat of Stratford Manor Addition showing the name of the street as Millerd Pond Drive.
· Filing a Certificate of Correction will also prevent the Central Appraisal District of Collin County, the Collin County Elections Department, the United States Postal Service, Emergency Services, and the Utility Billing correcting the spelling twice of Millerd Pond Drive which could cause confusion, and future mistakes.
· Once City Staff files a Certificate of Correction for Stratford Manor Addition, no further action will be needed.
If Council would like to change the name to Millard Pond Drive
· An Ordinance would need to be approved by City Council naming the street Millard Pond Drive.
· City Staff will contact Central Appraisal District of Collin County, the Collin County Elections Department, the United States Postal Service, Emergency Services, Utility Billing, and electronic mapping systems to change the name to Millard Pond Drive. City Staff will send notices to all property owners that have change of address.
· City Staff will update SDE Address Points and Road Centerlines layers in ARCMAP and will update the address record in HTE.
· A Certificate of Correction would need to be filed at Collin County for the portion of Millerd Pond Drive in the Wyndsor Grove neighborhood which is just west of Stonebridge Drive to Glendevon Drive. No changes will be needed for the portion of Millerd Pond Drive in the Stratford Manor Addition which extends from Glendevon Drive to Rosebury Circle.
· Emergency Services would strongly request that all segments of the roadway maintain a continuous name along its entire length due to potential confusion during an emergency call. Thus, Emergency Services would request if a name change is proposed that the portion of Millerd Pond Drive, east of Stonebridge within the Saddlehorn Ridge Phase 1 is included.
o The attached Ordinance would need to be modified to include the segment of the Millerd Pond Drive within Saddlehorn Ridge Phase 1.
o City Staff would contact the same entities, update ARCMAP and HTE whether only a portion of Millerd Pond Drive is changed or its entire length.
o An additional Certificate of Correction would need to be filed at Collin County for the portion of Millerd Pond Drive in the Saddlehorn Ridge Phase 1 neighborhood.
o By changing the name of the roadway to Millard Pond Drive within the Saddlehorn Ridge Phase 1 neighborhood may cause potential confusion for established homes with electronic mapping systems, and other services.
FINANCIAL SUMMARY:
· If this Ordinance is denied, the cost to file a Certificate of Correction with Collin County to correct the spelling of Millerd Pond Drive within the Stratford Manor Addition would be approximately $200.
· If this Ordinance is approved, the cost to make the appropriate changes to the signage would be approximately $335. A Certificate of Correction would also need to be filed for the portion of Millerd Pond Drive in the Wyndsor Grove neighborhood. The total cost would be approximately $535.
· If this Ordinance is approved with a modification to include the entire length of Millerd Pond Drive, an additional Certificate of Correction would need to be filed for the portion of Millerd Pond Drive in the Saddlehorn Ridge Phase 1 neighborhood. The additional cost to make the appropriate changes to the signage would be approximately $135. The total cost would be approximately $870.
