RECOMMENDED CITY COUNCIL ACTION:      
·      Staff recommends denial of the proposed rezoning request due to lack of conformance with the City of McKinney's Comprehensive Plan.
 
However, the applicant is requesting approval of the following provisions:
 
1.      The use and development of the subject property shall develop in accordance with Section 146-74 ("RS 45" - Single Family Residence District) of the Zoning Ordinance, and as amended, except as follows:
 
a.      The maximum density shall be 4.26 dwelling units per acre.
 
b.      The minimum mean lot size shall be 6,249 square feet, and the median lot size shall be 5,879 square feet.
 
2.      The subject property shall conform to the attached Architectural Standards.
 
·      Staff's professional opinion remains that residential uses may be appropriate in this location; however, Staff sees no reason why the subject property is unable to conform to the maximum density and minimum mean and median lot sizes outlined in the Comprehensive Plan.
 
ITEM SUMMARY:  
·      The applicant is requesting to rezone approximately 19.86 acres of land, located approximately 1,400 feet south of U.S. Highway 380 (University Drive) and on the west side of Bois D'Arc Road, from "AG" - Agricultural District to "PD" - Planned Development District, generally to allow for single family detached residential uses and modify the development standards.
 
·      At the August 19, 2014 City Council meeting, the Council tabled the item to the September 16, 2014 City Council meeting with the request that the applicant meet with Staff to discuss issues of density, lot size, and architectural standards.
 
·      At the September 16, 2014 City Council meeting, the Council tabled the item in order to give the applicant more time to revise the request. The applicant previously requested the property to be rezoned to the "RS 45" Single Family Residence District, and has since modified the request to include special ordinance provisions detailing the maximum density and minimum mean and median lot sizes, as well as provided residential architectural standards in an effort to address some of the concerns voiced by City Council at the August 19, 2014 meeting. The requested special ordinance provisions are detailed above and have been provided in the attached proposed ordinance. Staff has no opposition to the proposed architectural standards.
