RECOMMENDED CITY COUNCIL ACTION: 

Approval of the Resolution and variance

 

ITEM SUMMARY: 

  • In lieu of paying the inspection fee for inspections performed by City employees, the Owner of Oxford Place, DR Horton, requests that it may enter into a contract with JBI Partners, Inc. to satisfy the inspection requirements contained in the Subdivision Ordinance, for which Owner has agreed to be responsible for all associated costs and fees.
  •  
  • The proposed Oxford Place development is located near the intersection of County Road 412 and County Road 409 at the extreme northeast corner of the city’s extraterritorial jurisdiction (ETJ) as shown on the attached location map.
  •  
  • JBI Partners, the engineering firm representing Oxford Place, has retained the services of a former engineer for the City who oversaw the Construction Inspection team.  Thus, staff feels comfortable that appropriate inspections and testing will be undertaken.  Regardless, staff has the ability to review any testing or inspection reports generated by the third party inspections.
  •  
  • City inspectors have no other projects in the vicinity of Oxford Place, which is approximately nine miles driving from downtown.  A round trip would take over 30 minutes, which would limit time available to inspect other City projects.
  •  
  • The city inspection fee is 3.5% of the cost of public improvements broken out by 0.5% for engineering plan review services and 3.0% for actual construction inspection.  Approval of the development agreement also grants a variance to Section 2-1(b) of the Code of Ordinances regarding the 3% portion for construction inspection.
  •  
  • None of the improvements to be installed will be maintained by the City, as this project is in the ETJ, and water/sewer service is not being provided by the City.  Water will be provided by North Collin Special Utility District, and sewer will be through a previously approved on-site package plant.
  •  
  • Neither North Collin Special Utility District nor Collin County Engineering Department are opposed to the concept of third party inspections.

 

 

BACKGROUND INFORMATION:

                     A similar arrangement is in effect for the Trinity Falls development and has created no issues for the City.

 

FINANCIAL SUMMARY:

                     The agreement and variance are not anticipated to cause any increases in costs to McKinney. The Owner shall be entitled to the reimbursement of the already paid Inspection Fee for Phase 1 of the Oxford Place development in the amount of $111,200.51 upon successful completion of the inspection requirements for said portion of the property.
