Conduct a Public Hearing to Consider/Discuss/Act on the Request by Douglas Properties, on Behalf of David Huang, for Approval of a Request to Rezone Approximately 65.24 Acres from “AG” - Agricultural District to “PD” - Planned Development District, Generally to Allow for Single Family Residential Uses and to Modify the Development Standards, Located on the West Side of McDonald Street and Approximately 1,400 Feet North of Wilmeth Road, and Accompanying Ordinance

RECOMMENDED CITY COUNCIL ACTION:  Staff recommends denial of the proposed rezoning request due to a lack of conformance with the Comprehensive Plan.

 

However, if the rezoning request is to be approved, the following special ordinance provisions shall be applicable:

 

1.                     The use and development of the subject property shall conform to the regulations of Section 146-73 (“RS 60” - Single Family Residence District) of the Zoning Ordinance, and as amended, except as follows:

 

a.                     The subject property shall generally develop in accordance with the attached Zoning Exhibit.

 

b.                     The subject property shall be subject to the attached development regulations.

 

ITEM SUMMARY:

 

                     The applicant is proposing to rezone approximately 65 acres of land, located on the west side of McDonald Street (State Highway 5) and approximately 1,400 feet north of Wilmeth Road, from “AG” - Agricultural District to “PD” - Planned Development District, generally to allow for single family residential uses and to modify the development standards.

SPECIAL CONSIDERATIONS: 

 

                     At the February 14, 2012 Planning and Zoning Commission meeting, there was a fair amount of discussion amongst the Commission members regarding the approximately 100 acres of undeveloped City owned land located to the west of the subject property being developed as a City park in the future. Subsequent to this discussion, Staff did additional research on what the future plans for this property are.

 

                     In fact, the 100 acre City owned land located to the west of the subject property may not be developed as a City park at all. Redbud Boulevard is planned shift from its current alignment to the east in order to line up with Shawnee Drive which is located to the east of Naomi Press Elementary School just north of Bloomdale Road. This shift in Redbud Boulevard’s alignment will split the City owned property in to an eastern and western tract.  The City plans to build a pump station on the western tract, specifically the southwest corner of the tract.   The remainder of the west side of the tract where the quarry is currently could be developed as a City park pending the City’s future needs.  The property on the eastern tract may be developed in partnership with another governmental entity or sold for development.

 

                     In an effort to clarify this point for the City Council, a revised staff report rectifying prior references to a City park has been prepared and attached for reference.

BOARD OR COMMISSION RECOMMENDATION:

 

                     At the February 14, 2012 Planning and Zoning Commission meeting, the Commission voted 5-1 (Bush dissented) to recommend approval of the proposed rezoning request with the special ordinance provisions listed in the attached staff report.
