RECOMMENDED CITY COUNCIL ACTION:      
·      Staff recommends denial of the proposed rezoning request due to a lack of conformance with the Comprehensive Plan.
 
However, if the rezoning request is to be approved, the following special ordinance provisions shall be applicable:
 
1.      The use and development of the Single Family Residential portion of the subject property shall conform to the regulations of Section 146-106 ("SF5" - Single Family Residential District) of the Zoning Ordinance, and as amended, except as follows:
 
a.      All single family detached residential dwelling units shall be subject to the attached Single Family Architectural and Site Standards.
 
2.      The use and development of the Townhome Residential portion of the subject property shall conform to the regulations of Section 146-108 ("TH" - Townhome Residential District), and as amended.
 
3.       The use and development of the Commercial portion of the subject property shall conform to the regulations of Section 146-112 ("C2" - Local Commercial District), and as amended.
 
4.      The use and development of the Light Industrial portion of the subject property shall conform to the regulations of Section146-114 ("LI" - Light Industrial District) of the Zoning Ordinance, and as amended.
 
5.      Development on the subject property shall generally conform with the land use areas as shown on the attached Zoning Exhibit - PD Concept Map.
 
ITEM SUMMARY:  
·      The applicant is requesting to rezone approximately 112.91 acres of land from "AG"- Agricultural District to "PD" - Planned Development District generally to allow for commercial, single family attached residential, single family detached residential and industrial uses. In addition to the zoning designations for each of the above listed uses, the applicant is proposing architectural standards for the single family detached uses.
 
·      On March 6, 2012, the City Council denied a similar rezoning request for a portion of the subject property. With that rezoning request (11-191Z), the applicant requested to rezone the subject property (65 acres) for single family residential uses.
 
·      On November 6, 2012, the City Council denied a similar rezoning request by the previous applicant (12-093Z5) to rezone the property for single family residential uses (approximately 84 acres) and commercial uses (approximately 29 acres).
 
·      On June 10, 2014, the Planning and Zoning Commission tabled a similar rezoning request indefinitely per the applicant's request. The previous applicant (14-085Z2) requested to rezone the subject property for single family detached residential uses (approximately 62.46 acres) and commercial uses (approximately 29.35 acres).
 
·      The Northwest Sector Phase I Report was approved in February of 2015. Included in the Phase 1 Report are guiding priorities for specific Sub-Areas of the Northwest Sector. Though not technically located within the Northwest Sector Area, the subject property sits directly adjacent to the Northwest Sector and could easily be seen as an extension of the area. The vision calls for the area generally east of U.S. Highway 75 and south of Bloomdale Road to promote "business park" opportunities. With this in mind, any land use decisions related to residential uses should be carefully considered for their potential impact on the "business park" concept called for as part of the Phase I Report. The section of the Phase I Report relevant to this rezoning request has been included as an attachment for your reference.
