RECOMMENDED CITY COUNCIL ACTION:
• Adopt Resolution ratifying the Second Meet and Confer Agreement with the McKinney Police Association (MPA).
ITEM SUMMARY:
• City and Association teams began substantive discussions in January of 2012 and concluded in June with consensus on the attached First Meet and Confer Agreement.
• The amended agreement addresses items such as compensation and benefits for Police Officers and includes certain procedures and policies for the Police Department.
• Notable changes include:
o Removal of Judicial Supervisor or Marshal and Deputy Chief Positions from being covered in the agreement.
o Market data being defined as averages pay or benchmark cities plus 1.5%.
o Duration of the contract changed to two years from three years, to coincide with the Fire Meet and Confer Agreement. The agreement terminates on September 30, 2017.
§ Contract can be terminated early:
§ If a rollback election is passed by the voters and the City and Association cannot come to an agreement in 60 days; or
§ Police Officers are granted property right, due process or “just cause” right in their employment with the City and the City and Association are not able to come to an agreement within in 30 days.
o Limits the ability for bulletin board usage and deduction of association dues from their paycheck to only the recognized bargaining agent which is currently the McKinney Police Association.
o Included the same benefits received by the Fire Fighters in their Meet and Confer Agreement which includes:
§ Holiday Buy Back
§ Sick Leave Payout
§ Personnel Files
§ Grievance Procedure
• The agreement has been ratified by the MPA membership with 123 voting for the agreement, 21 voting against the agreement and 5 votes not cast.
• Ratification by the City Council through resolution will finalize the agreement.
BACKGROUND INFORMATION:
• Previous Council action pertaining to Police Meet and Confer:
o December 1, 2008 - Resolution No. 2008-12-192-(R) passed recognizing the MPA for the purpose of Meet and Confer discussions.
o First Amendment to the Meet and Confer Agreement May 12, 2012 - Resolution 2012-05-064(R).
FINANCIAL SUMMARY:
• This agreement gives structure to anticipated salary cost increases needed to maintain market competitiveness.
