RECOMMENDED CITY COUNCIL ACTION:
· Approval of the attached Resolution.
ITEM SUMMARY:
· This item authorizes the award of the contract for Erosion Control Materials and Emergency Repairs, Invitation to Bid 12-13FP, as follows:
o Sections A, B, and C - Installed Materials
§ Rose Contracting
o Section D - Furnished Materials
§ Copeland Sand & Gravel - Items 55, 86 & 91
§ Rose Contracting - Items 56-58
§ Hanes Geo Components - Items 59-69, 79-81, 84, and 88-90
§ Pipe products not awarded - Items 70-78
§ Reject all bids for Items 82, 83 ,87 and 92 (these items are available on Cooperative Contracts at a lower cost)
BACKGROUND INFORMATION:
· The Invitation to Bid was advertised on April 15, 2012 and six bids were received and opened on May 5, 2012.
· The bid documents allow the City to award the bid by individual section and/or line items; therefore, the bidders were permitted to bid on any portion of either section.
· The bids establish a unit price for each element of work. As a department needs these services, a purchase order is generated using funds already approved by the City Council. Therefore, there is no budget line item associated with these contracts; the approved budget already sets a limit for any department who would utilize these services.
· This contract will be utilized upon the failure of a developer or contractor to maintain adequate erosion control devices. For example, when a developer or contractor does not adequately install or repair erosion control devices as necessary to comply with Federal, State or local regulations and was provided an adequate amount of time to do so, the City will request corrective action to be completed by on-call contractors. The City will then be reimbursed by the developer through the Erosion Control Deposit Account established by the developer for their projects.
· The contract could also be utilized to address major erosive issues that require immediate attention.
· Section D of this contract provides materials necessary for the Public Works Department to continue the Healthy Creeks and Lakes program.
· This contract is for a period of one year, commencing on the date of award and can be renewed for two additional one-year periods at the City's discretion.
FINANCIAL SUMMARY:
· Funding for these services is currently budgeted in the following areas:
o Street Maintenance Operations
o Capital Improvements Program
o Healthy Creeks & Lakes
o Erosion Control Deposit Accounts (established by developers) - To be used for the correction of erosion control deficiencies.
