RECOMMENDED CITY COUNCIL ACTION:                     

                     Approval of the Agreement.

 

ITEM SUMMARY: 

                     The development of Aster Park, a 1,188 mixed use development, requires 23.76 acres of parkland dedication (one acre of parkland for every 50 residential units) in accordance with the previous Subdivision Ordinance regulations that this project is vested under. 

 

                     The developer is proposing 15.66 acres of parkland amenities which include a community center, 6 programmed park areas, 12 smaller park “nodes”, bike skills park, bird habitat area and almost 7 miles of 6’ wide interior multi use trails. 

 

                     Up to 50% credit towards parkland dedication for private recreation facilities is permitted.  With 23.76 acres required, the developer may receive a credit towards 11.88 acres.  The remaining 11.88 acres will be satisfied via cash in lieu of parkland dedication with each respective phase at time of plat filing. 

 

 

                     The ordinance further requires that the private open spaces must have a certain minimum level of improvements constructed in order to receive credits.

 

                     The improvements generally include landscaping, playgrounds, pavilions, walking trails, active recreation, and seating.

 

                     The land and improvements will be owned and maintained by the homeowner’s association. 

 

                     The credits will be applied to the first 594 residential lots.  Upon the exhaustion of the credits, the owner/applicant will pay cash in lieu of parkland for the remaining 11.88 acres.

 

                     The improvements must be constructed with each corresponding phase, or the expiration of 8 years from the date of this agreement.

 

 

BACKGROUND INFORMATION: 

                     City Council approved the preliminary-final plat for the subject property on May 18, 2022.
