Conduct a Public Hearing to Consider/Discuss/Act on a Resolution Amending the CDBG Citizen Participation Plan Under the City’s Consolidated Plan, FY 2015-2019

RECOMMENDED CITY COUNCIL ACTION:                     Approve the Resolution.

 

ITEM SUMMARY: 

                     The U.S. Department of Housing and Urban Development (HUD) issued an Affirmatively Furthering Fair Housing Rule, which requires local and state government receiving HUD funds to revise their current Citizen Participation Plan (CPP) to incorporate language that details the Assessment of Fair Housing (AFH) analysis within the plan.

 

BACKGROUND INFORMATION: 

                     HUD published a new, final rule (March, 2016) expanding the obligation to Affirmatively Further Fair Housing (AFFH).  The new rule replaces the Analysis of Impediments to Fair Housing (AI) with an Assessment of Fair Housing (AFH).  The AFH expands the examination and determination of Fair Housing Data, assessment of fair housing concerns and issues; and the identification of fair housing priorities and goals for the implementation and use of the City’s HUD funds.

 

                     The AFH report will be the result of the above analysis and conclusions.  The rule’s specific requirements serve to connect housing, quality of life investment planning and community development resources and policies with meaningful actions.

 

                     The proposed amendment includes specific consultation and community citizen participation requirements established by HUD to follow toward finalizing the city’s AFH at the required time the document is due and during the grant funding periods. The proposed amendment includes the following:

o                     Requirement to hold at least two (2) public hearings for the AFH; one during development of the report within the process and the second prior to approval; 

o                     The provision will also provide a 30-day public comment period prior to the finalization of the AFH;

o                     The provision of guidelines for access to records, technical assistance and fair housing complaints or concerns; and

o                     Inclusion of the Substantial Amendment process for the amendments to the AFH and the Citizen Participation Plan.

 

                     This Substantial Amendment to the Citizen Participation Plan to include AFH items will be under a 30-day public comment period January 22, 2017 to February 22, 2017. Citizens will also have the opportunity to provide public comments at the public hearing under City Council.  Comments received will be included in the final submission to the U.S. Department of Housing and Urban Development for review and final approval.

 

                     The amendments to the Citizen Participation Plan will be enacted under the Five-Year Consolidated Plan for program years 2015-2019 through September 30, 2020.

 

                     The City will continue to update City Council leaders and the public on AFFH actions through the city’s Annual Action Plans, Substantial Amendments, and the year-end Consolidated Annual Performance Evaluation Report (CAPER).

 

FINANCIAL SUMMARY: 

                     No impact to the general fund. The plan is a requirement as the city receives federal funding, including the Community Development Block Grant (CDBG), with an estimated funding allocation of more than $630,000 annually to the city.
