RECOMMENDED CITY COUNCIL ACTION:
• Approval of the resolution.
ITEM SUMMARY:
• This resolution authorizes the City Manager to amend the Texas State Soil and Water Conservation Board (TSSWCB) Project Agreement for federal funding to increase the maximum agreement amount from $351,000 to $4,500,000.
• The primary reason for the change is to add construction funding to the agreement, which has been the intention all along.
• This amendment also extends the term of the agreement from June 30, 2018, to June 30, 2020, to cover the entire anticipated construction period.
BACKGROUND INFORMATION:
• This dam, known locally as Brinkmann Ranch Lake, is located north of US 380 between Lake Forest Drive and Hardin Boulevard. It does not meet current safety standards. A failure of the dam would result in significant property damage and the potential loss of life.
• City Council approved the original TSSWCB Project Agreement for federal funding at a meeting on January 3, 2017.
FINANCIAL SUMMARY:
• At the time of the original agreement, it was agreed to show $0 for the estimated construction cost then amend the agreement later when actual construction costs were known. The bid opening occurred on May 10, 2018. The low bid amount was $4,960,863.70. The agreement is now being amended to add construction funding.
• The estimated project costs are as follows:
Construction: $ 5,500,000
Land Rights Acquisition: $ 210,000
Contract Administration: $ 40,000
Total Cost: $ 5,750,000
• This is one of two grants for this project. The NRCS is providing approximately $3,737,500 (65% of the overall project cost) to the TSSWCB, which is passing that on to the City by this grant.
• The other grant is also from the TSSWCB, however, it is for state funding. By that grant the state is funding 33.25% of the overall project. The two grants combined will fund 98.25% of the overall project.
• The estimated City contribution for this project is $100,625 (1.75% of overall project cost).
