RECOMMENDED CITY COUNCIL ACTION:                     

                     Staff recommends denial of the proposed specific use permit due to close proximity of the subject property to residential uses and a lack of conformance with the vision outlined in the Northwest Sector Study Phase 1 Report.

 

                     However, should the specific use permit request be approved, the applicant is requesting approval of the following special ordinance provisions:

 

1.                     An auto body repair and paint shop shall be permitted on the subject property.

 

2.                     The property shall generally develop in conformance with the attached site layout exhibit.

 

                     Since the Planning and Zoning Commission has recommended denial of the proposed specific use permit request, the item will need a favorable vote from ¾ of the City Council (6 members) in order to be approved.

 

ITEM SUMMARY: 

                     The applicant is proposing a specific use permit to allow a 14,600 square foot auto body repair and paint shop (Caliber Collision) on approximately 2.01 acres, located on the north side of U.S. Highway 380 and approximately 400 feet west of Hardin Boulevard.

 

                     The zoning for the subject property (“C3” - Regional Commercial District) requires that a specific use permit be granted in order for an auto body repair and paint shop to be constructed and operated on the subject property. As part of the specific use permit request, the applicant has submitted an informational only rendering of the building, as well as a site layout exhibit, which details the location of overhead bay doors along the east and west sides of the building, screening devices, and overnight parking located on the north side of the building.

 

                     On June 9, 2015 the Planning and Zoning Commission voted to table the item to the June 23, 2015 meeting due to public hearing notification signs not being posted on the property in the required timeframe.

 

                     On July 21, 2015 the City Council voted to continue the public hearing and table the item to the August 3, 2015 City Council meeting per the applicant’s request.
