                     Approval of the Resolution

 

ITEM SUMMARY: 

                     This item authorizes the Interim City Manager to enter into an agreement with W/J Wilmeth Ridge, L.P., regarding the reimbursement of construction costs incurred by the oversizing of a master planned wastewater main.

 

                     The contract price of the items associated with the oversized main and related appurtenances is $1,328,019.75.

 

                     The proposed agreement stipulates that the City agrees to participate in the cost of construction for the oversized portion of the off-site wastewater main, up to $759,441.37, which is the estimated difference between the costs of the oversized main and the cost to construct the City’s minimum standard 12” diameter main that would otherwise be sufficient to serve the Wilmeth Ridge South and Wilmeth Ridge North Subdivisions.

 

                     In no circumstances shall the City’s participation in costs exceed the difference between the cost to construct the standard 12” diameter line and the cost to construct the oversized main.

 

                     The location of the proposed off-site wastewater main is shown on the attached exhibit and will extend a total of 4,681 linear feet with both 30” and 36” diameter sections.

 

BACKGROUND INFORMATION: 

                     The existing annexation agreement (see attached) for the Wilmeth Ridge North and Wilmeth Ridge South Additions contemplates the reimbursement costs in Section D.8., stating the City will refund to the owner any costs incurred with the construction of both on-site and off-site oversized water and sewer lines.

 

                     The Wilmeth Ridge North subdivision is currently being developed.

 

                     A new ethics law enacted by H.B. 1295, prohibits a governmental entity or state agency from entering into certain contracts with a business entity unless the business entity submits a disclosure of interested parties (Form 1295). This completed and acknowledged Form 1295 has been attached.

 

FINANCIAL SUMMARY: 

                     The proposed agreement stipulates that the City agrees to participate in the cost of construction for the oversized wastewater main, up to $759,441.37.

 

                     Funds are available in WW4213 (Oversize Participation Bloomdale (Tucker Hill)) project to fulfill the obligations of this agreement.  This CIP project was created specifically for the installation of this sewer.

 

                     A companion resolution item is being considered concurrently by the City Council appropriating funds to accommodate the reimbursement of the oversized construction costs.
