RECOMMENDED CITY COUNCIL ACTION:
* Authorization of City Manager to execute an Interlocal Agreement ("ILA") between City of McKinney and McKinney Municipal Utility District No. 1, McKinney Municipal Utility District No. 2.

ITEM SUMMARY:
* The proposed Interlocal Agreement between City of McKinney and McKinney Municipal Utility District No. 1, McKinney Municipal Utility District No. 2 would allow the Districts to perform certain approved park maintenance and improvements in Trinity Falls.

BACKGROUND INFORMATION:
* The City and the Districts are authorized to enter into an Interlocal Cooperation Agreement under Chapter 791 of the Texas Government Code for the provision of governmental functions and services.
* The City and the Districts would benefit from the Districts performing ongoing maintenance and capital expenditures for those parks located within the Districts, including City-owned neighborhood parks and BB Owen park, as approved by the City in each fiscal year.
* The City and the Districts would enter into an agreement so that the City can reimburse maintenance and capital expenditures for parks from the park fees collected under the Trinity Falls Amended and Restated Development Agreement.
* The City Council approved a Term Sheet incident to this ILA in November 2021.
FINANCIAL SUMMARY:
* The use of the Trinity Falls Park Fees is consistent with the City's budget for park expenses.
