RECOMMENDED CITY COUNCIL ACTION:
* Staff recommends approval of the correction to Ordinance No. 1043.

ITEM SUMMARY:
* Staff is proposing to correct an error with the metes and bounds description of Ordinance No. 1043, which abandoned an approximately 265 foot long portion of Acker Street in January of 1978.

* Staff has discovered that the directional call-outs within the metes and bounds for the abandonment were incorrect. Staff is proposing to correct the metes and bounds description and to attach a location map exhibit, correctly illustrating the portion of Acker Street originally abandoned.

* It is important to note that this error has not had any effect on the abandonment of the roadway, as this portion of Acker Street has been treated as abandoned since the original adoption of the ordinance in 1978.

* Staff has attached an exhibit illustrating the difference between the metes and bounds description provided in Ordinance No. 1043 and the actual location of the abandoned portion which is provided for in the proposed correction ordinance.

BACKGROUND INFORMATION:
* The remainder of Acker Street, abutting the eastern boundary of the subject property, was also abandoned by Ordinance No. 1277 (attached) in 1982. The exhibit attached to Ordinance No. 1277 displays the correct location of the subject property.
