RECOMMENDED CITY COUNCIL ACTION:
• Approve the ordinance.
ITEM SUMMARY:
• This ordinance modifies Chapter 110, Article V.-Gas of the Code of Ordinances, to provide continuity between current franchise agreements and the Code.
• Section 110-341 “Purpose.” defines purpose as it is defined in the current adopted franchise agreements.
• Section 110-344 “Payment.” is revised to show that fees shall be payable as determined by individual agreements approved by city council.
• Since fees are determined by individual agreements, Appendix A, “Schedule of Fees”, Section 110-342 “Fee Imposed.” is hereinafter deleted
BACKGROUND INFORMATION:
• The City of McKinney previously adopted gas franchise ordinances, which were accepted by Atmos Energy Corporation and CoServ.
• These ordinances govern the distribution, supply, transportation, delivery and sale of gas within the City.
• In order to provide continuity between current franchise agreements and the Code, it is necessary to modify Chapter 110, Article V.-Gas of the Code of Ordinances.
