RECOMMENDED CITY COUNCIL ACTION: Approve proposed ordinance amendment.

ITEM SUMMARY:
· In March 2009, the City Council approved the addition of a new article to our Code of Ordinances, Chapter 62 adopting the vehicle idling restrictions of the Texas Commission on Environmental Quality (Ordinance No. 2009-03-016, attached).

· Under the current ordinance regulations, there is no restriction placed on drivers idling while using their vehicle’s sleeper berth at a service station, fueling station or gasoline station or on the number of vehicles allowed to idle while waiting in a queue for a fueling pump (the proposed change does not affect vehicles that weigh less than 14,000 pounds and do not have a sleeper berth).

· The first proposed amendment would prohibit a driver using a vehicle’s sleeper berth from idling at a service station, fueling station or gasoline station while the second proposed amendment will permit no more than one motor vehicle to idle while waiting in line to access a fueling pump. Staff feels that limiting the number of vehicles allowed to idle while waiting to fuel can help reduce the amount of emissions generated and help control air pollution from motor vehicles.
