RECOMMENDED CITY COUNCIL ACTION:
* Approval of Resolution

ITEM SUMMARY:
* This item authorizes the Interim City Manager to execute a Memorandum of Understanding (MOU) with TxDOT to facilitate the release of FM 3038 and Spur 359 from the State Highway System.

BACKGROUND INFORMATION:
* The City Council authorized the City Manager to request the removal of FM 3038 from the State Highway System on September 13, 2013.
* The City Council authorized the Interim City Manager to request the removal of Spur 359 from the State Highway System on July 15, 2014.
* TxDOT will release the roadways upon completion of the full depth repairs that are necessary on both roadways, which is scheduled to be completed in April of 2015.
* Construction of the Virginia Parkway Widening project is scheduled to begin in the Fall 2015.
* Franchise utility relocations will be extensive along this corridor, and will need to begin prior to April 2015 in order to maintain the project schedule.
* The MOU is needed so that design, right of way acquisition, and utility relocation can proceed outside the TxDOT review process.
* This MOU will be documentation to the franchise utility companies that the roadway will be taken off system, and allow them to move forward with their design process using the City's criteria.
* The MOU will also provide for the following items:
o Allow the City to permit any new development projects along either roadway outside the TxDOT process during this time period. This will be a benefit to the property owners along this roadway.
