RECOMMENDED CITY COUNCIL ACTION:
* Approval of Resolution

ITEM SUMMARY:
* This resolution authorizes the City Manager to enter into a Project Agreement with the USDA-NRCS to provide technical and financial assistance to rehabilitate Floodwater Retarding Structure Site 2A in the East Fork above Lavon Watershed (NRCS FRS 2A EFAL).

BACKGROUND INFORMATION:
* This proposed rehabilitation of Site 2A is authorized under Public Law 83-566, where the USDA-NRCS provides 65% of the funding needed to upgrade the dam and the local sponsor (the City) provides the remaining 35%.
* The dam is situated on the future Highland Lakes development located east of Custer Road and north of Bloomdale Road as shown on the attached location map. The lake is proposed to be part of a future City park as stated in the Highland Lakes Development Agreement.
* The City of McKinney, Collin County, and the Collin County Soil and Water Conservation District, the Sponsoring Local Organizations (SLO's), submitted an application for Federal assistance to upgrade NRCS FRS 2A EFAL in 2007.
* This Project Agreement amends the Memorandum of Understanding (MOU) dated October 22, 2009.
* The attached Statement of Work identifies the City of McKinney costs and the maximum in-kind credit values as follows:
Construction: $1,472,250
Landrights: $145,000
Administration: $5,000
Total $1,622,250
