RECOMMENDED CITY COUNCIL ACTION:
· Approve and Adopt Ordinance Amendment

ITEM SUMMARY:
· The new Chapter 87, Special Events defines the different types of special events and the Special Event Permit (SEP) Manager
· The Amendment establishes several provisions, including:
· The application process for special events to be held in the city;
· Obtaining a special permit for an event;
· Cancellation and revocation of permits and provides for an appeal process;
· Standards for special events parades;
· Requirements for serving alcoholic beverages at a special event
· Giving a timeline of fourteen (14) days for the Special Event Committee to approve or deny an application after a complete application is received, with all required fees and licenses and/or permits.
· Provides for an alternate special event process for expressive activity events that do not affect public rights-of-way.
· Broadens the exemption for demonstrations, parades and assemblies held for current events that do not affect public rights-of-way.
· In addition, this Amendment modifies standards related to insurance and indemnification requirements, revises definitions and updates language within the document in accordance with recent case law.
· The Amendment also repeals Article VII, “Special Events” of Chapter 74 of the Code of Ordinances and Article V, “Parades,” of Chapter 90 of the Code of Ordinances.

BACKGROUND INFORMATION:
· The special event permitting process transitioned to the McKinney Police Department in 2009.
· The current Special event Ordinance, which was passed in 1992, states that the Parks & Recreation Department shall regulate the issuance of special event permits.
