ITEM SUMMARY:
· This item authorizes the Interim City Manager to abandon unnecessary drainage easements and a detention pond maintenance agreement within Heatherwood Phase 4.
· Heatherwood Phase 4 is located northwest of the intersection of Lake Forest Drive and Wilmeth Road as shown on the attached plat exhibit.
· Also shown on the attached plat exhibit are the locations and filing information for the easements.
· The easements were granted during earlier phases of the Heatherwood development and were for temporary facilities that were necessary until the permanent facilities were installed.
· The plat of Heatherwood Phase 4 now accounts for new easements/right of way at other locations, and detention/creek improvements were not required per the revised Storm Water Management Ordinance.
BACKGROUND INFORMATION:
· Homes are proposed to be constructed over the areas where these easements are no longer necessary.
· Clear title to the properties cannot be obtained without the abandonments.
