RECOMMENDED CITY COUNCIL ACTION:      
·      Approval of the Ordinance.
 
ITEM SUMMARY:  
·      This Ordinance amends Section 142-105 (10) of the City of McKinney Code of Ordinances, by extending the deadline for the expenditure of median landscaping funds paid into escrow by developers in situations where the median area has not yet been created.
 
BACKGROUND INFORMATION:
·      Median landscaping improvements are required as adjacent properties are developed.
·      In lieu of installing the landscape improvements, the developers are provided the option to escrow the cost of the landscaping.
 
·      The current regulations require the escrowed median landscaping funds to be expended within 6 years of collection.
 
·      Arterial roadways are often constructed in phases, where only one side of the roadway is completed.  In these cases the lanes on the opposite side of the median must be completed before there is an area available to be landscaped.
·      In some cases, the median area is not completed in time to meet the deadline for the expenditure of the escrowed median landscaping funds.
 
·      This Ordinance provides for the ten-year deadline to be calculated beginning on the date a median is available for landscape improvements.
 
·      Attached is a redline copy of the Ordinance showing the proposed changes.
 
FINANCIAL Summary:
·      This amendment will not affect the deadline for the landscape fees currently in escrow.
