RECOMMENDED CITY COUNCIL ACTION:
* Approval of the attached Resolution.

ITEM SUMMARY:
* The Hardin Fencing project includes replacement of an existing retaining wall and fencing.

* This bid includes replacing the wooden fence with a vinyl fence with the exception of three lots that have a retaining wall associated with them.

* Delta Specialty Contractors submitted the lowest responsive bid for the construction of the project for an amount of $86,280

* Staff recommends award of a contract not to exceed $95,000.

* A total of three bids were submitted and accepted.

* The lowest bidder failed to furnish bid bond/surety therefore was considered non responsive and was eliminated from award considerations.

BACKGROUND INFORMATION:
* Staff recommends accepting the bid from Delta Specialty Contractors for the construction of the Hardin Fencing project.

* In the 1991 Vistas of Eldorado Facility Agreement and the 1996 Eldorado Crossing Facility Agreement, the City is responsible for the screening and buffering along Hardin Boulevard.

* Staff is currently in negotiations for a design contract to design the retaining wall and fencing on the three remaining lots.



FINANCIAL SUMMARY:
* The?Hardin Fencing project (PK3247) is a FY13-14 Capital Improvements project funded by the Park Construction Fund.

* The total project funding including the design and construction of the fencing is $100,000. Additional funds will be required when the retaining wall portion of the project is bid.
