RECOMMENDED CITY COUNCIL ACTION:
• Staff recommends approval of the requested specific use permit extension.
ITEM SUMMARY:
• The applicant is requesting an extension of the specific use permit approval in order to allow adequate time to obtain a building permit for a restaurant with drive-through window. Currently, Section 146-41 (Specific use permits) of the Zoning Ordinance states that a building permit must be obtained within six months of specific use permit approval. The applicant received approval of a specific use permit (SUP) to allow a restaurant with drive-through window on the subject property on April 7, 2015 (Ordinance No. 2015-04-027), and an extension on August 3, 2015, which is set to expire on March 31, 2016. With the approval of this extension request, the applicant will have until October 1, 2016 to obtain a building permit. Staff has no objection to the requested extension (see attached letter) and recommends approval of the request.
