RECOMMENDED CITY COUNCIL ACTION:
* Approval of the Agreement

ITEM SUMMARY:
* This item authorizes the City Manager to enter into a lease agreement with Plano Sports Authority (PSA) regarding the lease of a portion of Gabe Nesbitt Park and the construction of certain site improvements to the park.
* The agreement provides for PSA to lease the property and to construct, own, maintain and operate a multi-purpose indoor athletic facility, including offices, and other multi-use indoor spaces.
* The agreement also spells out the responsibilities of both the City and PSA regarding construction of both public and private facilities and infrastructure.
o On December 17, 2013 the City Council approved an ordinance amending the Fiscal Year 2014 Annual Budget to provide funds for Gabe Nesbitt Park infrastructure improvements.
o A total amount of $1,840,000 was transferred into a new CIP project named Gabe Nesbitt Park Infrastructure Improvements (CO4271).
o This CIP project includes site utilities, landscaping, irrigation, lighting, drainage (including retention/detention), franchise utilities, sidewalks and other site improvements to the park necessitated by the upcoming construction of the City of McKinney Aquatic Center and the PSA Center, both of which will be located in the northern portion of the park.
o PSA desires to have an operational facility prior to the beginning of fall basketball season which begins on December 1, 2014.
