RECOMMENDED CITY COUNCIL ACTION:
* Approval of the Agreement

ITEM SUMMARY:
* This item authorizes the City Manager to enter into an agreement regarding the City of McKinney's use of the Clemmons Creek sewer line.
* A sample agreement is attached herewith.
* Melissa, as part of their request for McKinney's support for their request to become a member city of North Texas Municipal Water District (NTMWD), has extended this offer.
* This sewer may promote development within McKinney's ETJ by reducing the cost of sewer service to properties within the Clemmons Creek drainage basin.

BACKGROUND INFORMATION:
* The sewer line was constructed by the City of Melissa in 2005.
* A business owner within McKinney's ETJ has requested sewer service from the City of McKinney since the property is located within McKinney's sewer service area.
* The Clemmons Creek sewer line is located near this business owner's property, but Melissa requested that the owner contact the City of McKinney for service since the property is not in their service area.
* Since no McKinney sewer lines are available near the business owner's property, it would be cost prohibitive for him to extend a McKinney sewer.
* This customer receives water service from North Collin Water Supply Corporation. Since McKinney does not provide water service to this customer, a separate agreement will be required in order to properly bill the customer for sewer service.
* This agreement will allow the business owner and other potential developers within the drainage area and in McKinney's ETJ to connect to the Clemmons Creek sewer.
