RECOMMENDED CITY COUNCIL ACTION:      
·      Approval of the Agreement
 
ITEM SUMMARY:  
·      This item authorizes the following revisions to the 2012 Agreement with Trinity Falls:
o      Proposed amendments to the agreement to be consistent with the recently approved agreements allowing North Collin Water Supply Corporation (NCWSC) to provide water for the initial phases of the development.
o      Proposed amendments to allow the deferral of required screening and buffering for a three month period.  This change has been proposed to avoid the need for multiple deferral agreements throughout the many phases of the Trinity Falls project.
 
BACKGROUND INFORMATION:  
·      Trinity Falls is nearing completion of the first phase of the subdivision.
·      These revisions are necessary in order to accept the public improvements and defer the landscaping requirements based on City ordinances.
·      The agreements with NCWSC were approved in December, authorizing NCWSC to provide water for the first 450 homes within Trinity Falls.  These agreements:
o      Created a method to avoid flushing a significant amount of water during the early phases of construction.
o      Reduced costs to both the developer and the City by deferring the installation of major water system improvements.
o      Created cooperation between the City of McKinney and NCWSC, benefitting customers of both water providers.
 
FINANCIAL SUMMARY:  
·      No negative financial impacts to the City of McKinney are anticipated due to the provisions of this agreement.
