RECOMMENDED CITY COUNCIL ACTION:
· Conduct the first of three public hearings regarding a voluntary petition for annexation.

· In accordance with the Texas Local Government Code, the City Council will hold this first public hearing at the special meeting at 5:45 p.m., and a second public hearing is scheduled for the regular City Council meeting on February 19, 2013, at 6:00 p.m. Final action regarding the petition for annexation will be considered at the March 19, 2013 City Council meeting, concurrently with a proposed zoning request and a developer’s agreement.

ITEM SUMMARY:
· The applicant has submitted a petition for voluntary annexation to the City of McKinney for an approximately 29.43 acre tract of land. The subject property is located on the northeast corner of Wilmeth Road and County Road 161 (future Ridge Road).

· The subject property, if annexed, will be zoned pursuant to a pending zoning case (13-012Z) that will be considered at the March 19, 2013 City Council meeting. The associated zoning request will cover the same land area as contained within the annexation petition.

· The applicant is requesting the subject property be zoned in conformance with the “BN” - Neighborhood Business District (approximately 14.36 acres) and “PD” - Planned Development District with a base zoning designation of “RS 60” - Single Family Residence District (approximately 15.07 acres). The applicant has requested a maximum density of 3.4 dwelling units per acre, and has requested a mean and median lot size of 7,200 square feet.
