RECOMMENDED CITY COUNCIL ACTION:                     

                     Approval of Ordinance Amendment

 

ITEM SUMMARY: 

                     This amendment to the noise ordinance will allow the Director of Engineering or the Building Official to make an exception to allow construction between the hours of 9:00 pm and 6:00 am, if certain conditions are met.

 

BACKGROUND INFORMATION: 

                     The current noise ordinance:

o                     Prohibits construction activities between the hours of 9:00 pm and 6:00 am. 

o                     Requests for an exception must be made to the Police Department.

o                     Contractors make the exception request to the inspector, who then instructs them to contact the Police Department (PD).  PD receives the request, then contacts either Engineering or Building Inspection for evaluation of the request.  If the request is approved PD will then issue the exception and notify Engineering or Building Inspection.

o                     The exception may be granted if the placement will take longer than four hours and the heat index is forecasted to be above 100 degrees by noon, or if, in the opinion of the Director of Engineering or Building Official, denial of the request would cause adverse impact to public safety.

                     Approval of this amendment will allow Engineering or Building Inspection to approve the request and eliminate several steps.  PD will be notified of any exception granted.

                     Council discussed this item on January 23, 2017, and approved bringing it back for action.

                     Currently a fee of $25 is charged for the variance request.  The same fee will apply.
